Mr.Sanjay Kumar, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and learned APP for the State.

In view of the role assigned to the applicant and the allegations contained in the F.I.R, this Court finds that the specific allegations were against one Ganesh Rai @ Ganesh Kumar @ Ganesh Kumar Singh @ Ganesh Singh who has been bailed out by a coordinate Bench of this Court vide order dated 29th November, 2018 passed in Cr. Misc. No. 67992 of 2018.

In the circumstances and keeping in view the role of the applicant, it appears that the case of the applicant does not stand at a lower pedestal than that of Ganesh Rai and, therefore, he is entitled for bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Danapur, Patna in connection with Maner P.S. Case No. 408 of 2018 with following conditions:

Patna High Court Cr.Misc. No.898 of 2019(2) dt.17-01-2019 2/2 (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
