JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Belaganj P.S. Case No. 181/18, disclosing offences under Sections 341, 323, 325, 307, 337, 379 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that while the informant was returning, petitioner and one Raushan Kumar attacked him and due to which, he fell down and thereafter, he was assaulted by bricks and the accused persons snatched away gold chain and cash of Rs. 2,000/- Submission of learned counsel for the petitioner is that he has falsely been implicated in this case due to land dispute and further he is an Army personnel and is ready to abide by any condition imposed on him.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Belaganj P.S. Case No. 181/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that petitioner shall cooperate in the investigation and make himself available as and when required by the police otherwise, his bail bond shall be cancelled.
