JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioners apprehend their arrest in connection with Kuchaikote P.S. Case No. 134 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code. Allegation as per FIR is that son of petitioner No.1 has kidnapped the daughter of the informant and informant apprehended the hands of the petitioners in that. Submission of learned counsel for the petitioners is that the main allegation is against son of the petitioner No.1 and petitioners are mother and Bhabhi of the main accused and nothing specific has been attributed against them. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of
Patna High Court Cr.Misc. No.78888 of 2018(2) dt.11-01-2019 2/2 arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Gopalganj, in connection with Kuchaikote P.S. Case No. 134 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
