Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. The petitioner is in custody since 28.03.2017. Earlier prayer for bail was refused twice by this Court by order dated 07.02.2018 and 13.03.2019.

The report of the trial Judge would reveal that the case is pending for prosecution evidence. The petitioner is ready to cooperate with the trial.

No.80351 of 2019(3) dt.25-09-2020 2/2 Considering the period already undergone and no chance of conclusion of the trial in near future due to Covid-19 effect, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.398 of 2017, arising out of Katoriya P.S. Case No.25 of 2017 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
