JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 This application, for grant of anticipatory bail, arises out of Nayagaon P.S. Case No. 67 of 2018, disclosing offences under Sections 341, 323, 337, 338, 307, 427, 448, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of assault to the informant causing injuries to him. Submission of learned counsel for the petitioner is that petitioner is the nephew of the informant and has falsely been implicated in this case. Further submission is that there is case and counter case between the parties and although it is alleged that petitioner and others assaulted the informant, however all the injuries caused to the informant was found to be simple in nature.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Nayagaon P.S.
