The petitioner seeks bail in connection with Chautham P.S. Case No. 122 of 2017 (G.R. No. 1831 of 2017), registered for the offence punishable under Sections 302, 120(b) and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 57604 of 2017 vide order dated 02.02.2019, Cr. Misc. No. 20097 of 2018 vide order dated 03.05.2018, Cr. Misc. No. 37187 of 2018 vide order dated 28.06.2018, Cr. Misc. No. 51826 of 2018 vide order

Patna High Court CR. MISC. No.65981 of 2019(2) dt.13-11-2019 2/2 dated 20.09.2018 and Cr. Misc. No. 69560 of 2018 vide order dated 06.12.2018. The petitioner has no criminal antecedent and he is in custody since 25.08.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S.
