The petitioner seeks bail in a case registered under Sections 341, 323, 307, 379, 324, 504 and 506/34 of the Indian Penal Code.

The prosecution case in short is that the informant was coming from his field and while he reached near Sheo Temple, the co-accused started abusing him and on protest, the accused persons having variously armed appeared there and assaulted the informant, as a result of which, the informant sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.65801 of 2019(2) dt.17-10-2019 2/2 petitioner is in custody since 13-08-2019. The allegation of assault is against co-accused namely Chandra Shekhar and Shambhu Mishra. No overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Sasaram in connection with Nokha (Dharampura) P.S. Case No. 172 of 2019.
