The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 324, 379, 504, 506, 427, 307 of the Indian Penal Code.

The allegation against the petitioners and other co-accused persons is that they, variously armed, entered into the house of informant. Allegation against Pradeep Mehta (Petitioner No. 1) is that he assaulted

It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. There is no specific allegation against the petitioner No. 2, rather the allegation levelled against him is general and omnibus. It is submitted that the injury sustained by the informant, inflicted by petitioner No. 1, is simple in nature. Moreover, petitioners are languishing in judicial custody for more than 3 months.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged

Patna High Court CR. MISC. No.76372 of 2023(2) dt.30-11-2023 3/3 on bail in connection with Supaul (Laukaha O.P.) P.S. Case No. 518 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul.
