The petitioner is in custody in connection with Barharia P.S. Case No. 302 of 2018 registered for the offence punishable under Section 272, 273, 308 of the Indian Penal Code and 30 (a), 41 (1) of the Bihar Excise and Prohibition Act 2016.
Learned counsel for the petitioner admits that earlier petitioner has been made accused in two cases in similar such allegation, however petitioner has been granted bail in such cases. He submits that in the instant case 15 liters liquor was recovered from the shop of the petitioner and the petitioner is in custody 28.09.2018.

No.620 of 2019(2) dt.17-01-2019 2/2 Considering the fact that petitioner is a shopkeeper, the Court directs to release the petitioner on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum- Special Judge Excicse, Siwan in connection with Barharia P.S.
