The petitioner apprehends his arrest in Nawada Town P.S. Case No. 366/2014, registered for the offences punishable under Sections 384, 307, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.
The victim named the petitioner along with his brother, father and others and alleged that Bhola Singh demanded extortion and also exhorted his son to kill, on such, Anish Kumar @ Raja Babu son of Bhola Singh fired which hit the informant and the accused persons took away Rs. 2,50,000/- from the chest of the shop.
Learned counsel for the petitioner submits that petitioner happens to be the younger son of Bhola Singh. The police after investigation found the case true only against Anish
Patna High Court Cr.Misc. No.79985 of 2018(2) dt.11-01-2019 2/2 Kumar @ Raja Babu and the accusation against the petitioner and his father was found false and accordingly, submitted final form, as not sent up against the petitioner. Petitioner has got no criminal antecedent.
Taking into consideration the fact that police found the accusation against the petitioner false and petitioner has got no criminal antecedent, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 366/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
