JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 This application, for grant of anticipatory bail, arises out of Dhoraiya P.S. Case No. 63 of 2019, disclosing offences under Sections 302/34 of the Indian Penal Code. Prosecution case is that brother of informant had gone to Banka but he did not return but later on his dead body was found in the yard and it is alleged that the deceased was earlier threatened by co-accused Manoj Manjhi and his family members and it is allted by the informant that said Manoj Manjhi along with others including petitioner killed his brother. Submission of learned counsel for the petitioner is that he has been made accused in this only on the basis of suspicion and except that there is nothing against the petitioner and there was no enmity between the petitioner and the deceased and even during investigation, no incriminating

Learned counsel for the State could not controvert the above submission.
Having heard both sides,in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate -Ist Class, Banka, in connection with Dhoraiya P.S. Case No. 63 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
