The petitioner apprehends his arrest in Forbesganj (Simraha) P.S. Case No.467 of 2017 registered under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. Md. Ausarul named the petitioner along with other accused persons who are alleged to have assaulted the informant and his father Learned counsel for the petitioner submits that there is counter version being Annexure 3. Only omnibus and general allegation of assault is made out. The informant got simple injury and the father of informant did not get any injury. The occurrence took place due to land dispute.

Considering the fact that the occurrence took place

Patna High Court Cr.Misc. No.79974 of 2018(2) dt.10-01-2019 2/2 due to land dispute, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No.467 of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
