2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 147,148 & 149 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, this petitioner along with other accused persons caused gun shot injury on both legs of the informant.
4. Learned counsel appearing for the petitioner submits that there is no disclosure in the FIR as to who caused gun shot injuries on the informant's leg and who was carrying fire arms at the time of firing. Allegation of firing is general and omnibus and no specific overt act has been alleged against him. Doctor has found simple injury.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.74883 of 2023(2) dt.29-11-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IX, Patna in Gopalpur Police Station Case No. 75 of 2017, GR No. 3428 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
