The petitioner seeks anticipatory bail in connection with Complaint Case No. 06 of 2018, registered for offences punishable under Sections 406, 409, 420, 193 and 177 of the Indian Penal Code.
It is alleged in the F.I.R. that 102 pieces small calves were handed over to the petitioner to keep them in his pound for medical examination of the calves but the petitioner has given false assurance of the same, as a result of which huge loss of revenue was occurred.
Submission of the learned counsel for the petitioner is that the petitioner has not committed any offence as per report of the veterinary doctor and inspite of that he is ready to deposit Rs. 51,000/- in three installments.
Patna High Court Cr.Misc. No.78533 of 2018(2) dt.09-01-2019 2/2 Heard the learned A.P.P. , who opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named, surrender within six weeks of receipt of order and deposit 50 % of the total amount and he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka East Champaran in connection with Trial No. 1761 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. and the rest of the said amount will be deposited in two equal installments within two months, which shall be payable in first week of each month and failure to deposit any installment, his bail bonds shall be cancelled, however once total amount is paid, his bail bond shall be confirmed.
With the aforesaid, this application is accordingly disposed of.
