The petitioner seeks bail in a case registered under Sections 341, 323, 324, 354 of the Indian Penal Code and 37(c) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that in drunken state, the petitioner entered the house of his daughter-in-law and misbehaved with her.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-07-2019. Charge sheet/Prosecution report in this case has already been submitted. There is no recovery of liquor. The petitioner is said to have
Patna High Court CR. MISC. No.72875 of 2019(2) dt.15-11-2019 2/2 misbehaved the informant in drunken state. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 6421 of 2019 arising out of Dulhin Bazar P.S.
