Mr. Khurshid Anwar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Musrigharari P.S. Case No. 111 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 47 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 35.64 litres of illicit liquor from an Ambassador car and the co-accused persons who were apprehended are said to have taken the name of the petitioner as the person who was the owner of the said illicit liquor.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and

It is further submitted that barring one case in which the petitioner is on bail, the petitioner is having a fair antecedent and he is languishing in custody since 07.01.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3-cum-Special Judge Excise, Samastipur in connection with Musrigharari P.S. Case No. 111 of 2018.
