Petitioner is in jail custody since 21.8.2019 in connection with S.Tr. No. 455 of 2014 (arising out of Birupur P.S. Case No. 22 of 2012) registered for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and 27 of the Arms Act.
Earlier, petitioner was granted privilege of bail by this Court vide order dated 7.10.2013 passed in Cr. Misc. No. 32885/2013 but his bail bond was cancelled on 5.6.2016, as petitioner failed to appear before the trial court. However,
Patna High Court CR. MISC. No.74007 of 2019(3) dt.16-09-2020 2/3 petitioner, voluntarily, surrendered before the court below on 21.4.2019.
Learned counsel appearing for petitioner submits that petitioner was remanded in G.R. No. 1788/2015 on 10.11.2015 and he remained in judicial custody in above stated case till 23.4.2016. He, further, submits that, unfortunately, learned counsel of petitioner failed to make Pairvi in the present case, resulting the cancellation of bail bonds of the petitioner. He, further, submits that petitioner having got bail in G.R. No. 1788 of 2015 went outside the State in connection with his livelihood and that was the reason he could not get any information regarding cancellation of his bail bonds in present case but as soon as he got information about the cancellation of his bail bond in the present case, he, voluntarily, surrendered before the trial court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Lakhisarai in connection with S.Tr. No. 455 of 2014 (arising
