JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Two bags containing 44.250 liters and 53.250 liters Indian made foreign liquor were recovered beneath seat of a train and the petitioners were found sitting on the aforesaid seat. Submission on behalf of the petitioners is that petitioners have no concern with seized bags but they have been implicated in this case on mere suspicion and, moreover, the petitioners do not have any criminal antecedents.

No.66524 of 2019(2) dt.04-11-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioners are languishing in jail custody since 13.9.2019, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Jamui in connection with Rail Jhajha P.S. Case No. 135/19.
