The petitioner is in custody in connection with S.Tr. No. 262/2009/376/2015 (arising out of Deo P.S. Case No. 46 of 2009) for the offences under Sections 323, 341, 504, 379/34, and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal history and he is in custody since 26.06.2018. He further submits that petitioner was earlier granted bail on merit, however, he jumped bail and absconded and as such his bail bond was cancelled.
Learned counsel for the petitioner submits that petitioner was at Surat in connection with job as labourer. He submit that although he returned back to his village but he was absent on the date of judgment.

No.79665 of 2018(2) dt.15-01-2019 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Aurangabad in connection with S.Tr. No. 262/2009/376/2015 (arising out of P.S. Case No. 46 of 2009). Subject to the condition that petitioner will exchange full cooperation in the Trial and in the event he is found absent and caused delay in the conduct of trial, the court below shall be at liberty to cancel the bail bond of the petitioner.
