JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 356 of the Indian Penal Code.

As per the prosecution case while the informant was standing near the clinic of Dr. P. Tuti, 3 unknown motorcycle borne miscreants snatched his mobile and fled away. Learned counsel for the petitioner submits that petitioner is not named in F.I.R. Name of petitioner transpired during course of investigation in the confessional statement of co-accused. No stolen article has been recovered from his possession.

Learned counsel for the State opposes the prayer for bail. There is specific allegation against the petitioner that he is mastermind of the alleged occurrence, which is evident from the
