Patna High Court CWJC No.18572 of 2024 dt.06-12-2024 2/3 ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 06-12-2024 The writ petition filed as a public interest litigation seeks proper inquiry and direction against the officials of the Respondent No. 11, Rajkiya Tibbi College & Hospital (for brevity 'College'), who have allegedly admitted students to the BUMS Course, on the strength of forged and fabricated marksheets/certificates of Fazil. The admission of the 16 students who are referred to Annexure-P/2, is also to be cancelled, is the submission; raised without impleading any of these students.
2. The averments in the writ petition is supported by representations produced as Annexure-P/1 and Annexure-P/2, which speaks of the 16 students who have been wrongly admitted to the College. The recommendation made itself is of the year, 2020 and there is no reason to now initiate an inquiry, after four years, especially since none of the affected students have been impleaded herein, who would be prejudiced by any orders passed by us.
3. We find no reason to entertain the public interest litigation, but make it clear that any orders passed in the inquiry with notice to the students, against whom allegations are raised, would not be affected by the dismissal of the writ petition.
