JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Bhargama P. S. Case No. 200 of 2019, disclosing offences under Sections 341, 323, 384, 379, 504, 506/34 of the Indian Penal Code.

As per F.I.R. there is allegation against the petitioners is of demanding Rs. 20/- from the informant, who is a tempo driver as a Rangdari and on refusal, assaulting him. Submission of the learned counsel for the petitioners is that as a matter of fact, the motorcycles of the petitioners dashed the tempo of the informant, due to that some scuffle took place. They have no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sri Kumod Ranjan, Judicial Magistrate, 1st Class, Araria, in connection with Bhargama P. S. Case No. 200 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
