The petitioner is in custody since 27.08.2019 in connection with Special Case No. 4173 of 2019 arising out of Khajekala P.S. Case No. 50 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that only because the motorcycle from which the alleged recovery is said to have been made was belonging to the petitioner, he has been taken into custody. He further submits that the co-accused from whom the recovery has been made has been released on bail vide order dated 01.07.2019 passed in Cr. Misc. No. 37334 of 2019.
