This application for anticipatory bail arises out of Chapra Mufassil P.S. Case No. 470 of 2018, disclosing offences under Sections 341, 323, 324, 504, 506 and 307/34 of the Indian Penal Code.

It is alleged that the accused persons assaulted the informant. According to the informant, petitioner no.1 had attempted to hit on the informant's head with his Farsa, which he (informant) could stop with his left hand. It is submitted on behalf of the petitioners that the injury report belies the allegation of causing injuries with any sharp-cutting weapon as the injuries have been found to have

Patna High Court Cr.Misc. No.80342 of 2018(2) dt.24-01-2019 2/2 been caused by hard and blunt substance. There is a counter version of the same occurrence and the FIR has been registered, learned counsel for the petitioners contends. Considering the aforesaid submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Chapra Mufassil P.S. Case No 470 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
