The petitioners prayed for regular bail in connection with Chanan P.S. Case no. 126 of 2021 instituted for the offence under Sections 272, 273/34 of the IPC and Section 30(a)(b)(c) of the Bihar Prohibition and Excise Act.

As per FIR, allegation against the petitioners along with co-accused persons is that they are indulged in business of carrying illicit liquor and when police raided at the place of occurrence, they recovered 500 liters Jawa Mahua. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They has falsely been implicated in this present

Patna High Court CR. MISC. No.262 of 2023(2) dt.24-03-2023 2/2 case. Petitioners have no concern with the alleged recovery or with the place of occurrence. No any incriminating article has been recovered from conscious possession of the petitioners. Moreover, similarly situated co-accused namely, Pankaj Ram has already been granted bail by a co-ordinate Bench of this Court vide order 13.1.2023 passed in Cr. Misc. No. 68836 of 2022. The petitioners are languishing in judicial custody since 13.9.2022.

Learned APP appearing for the State has vehemently opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Chanan P.S. Case No. 126 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge IVth-cum-Special Excise Court No. 1st Lakhisarai. (Sunil Kumar Panwar, J) Amandeep/- U T
