The petitioner is in custody since 26.08.2019 in connection with Guraru P.S. Case No. 107 of 2019 for the offence registered under Sections 406 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is false and frivolous and only because the petitioner had taken some construction materials from the informant, the petitioner has been roped in connection with the present case. It is further submitted that no generator was ever supplied to the petitioner so the question of sale does not arise. There is no paper on record with the informant to show that he had in fact extended the benefit of such generators to the present

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - V, Gaya in connection with Guraru P.S. Case No. 107 of 2019.
