The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 5 liters of foreign liquor is said to have recovered from the motor-cycle. He further submits that allegation against the petitioner is that he has fled away from the place of occurrence living motor-cycle. He submits that petitioner is the owner of the said motor-cycle. He further submits that petitioner have got no criminal antecedents as

Learned APP for the State opposes the bail application.

Considering the facts and circumstance of the case and the fact that the recovery is made from the motor-cycle of the petitioner, I am not inclined the enlarge the petitioner on bail in connection with Rafiganj P.S.
