The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b)a, 26/35 of the Arms Act.

As per prosecution case, after getting information, informant along with police party reached at the place, where petitioner along with co-accused persons assembled to commit any crime, and arrested them. It is further alleged that from the possession of this petitioner one country made pistol and one knife were recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. It is

No.73452 of 2022(2) dt.21-03-2023 2/2 further submitted that nothing any incriminating articles have been recovered from the conscious possession of this petitioner The petitioner has got no criminal antecedent moveover, he is languishing in judicial custody since 13.09.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of this petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mejorganaj P.S. Case No. 292 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I Sitamarhi.
