The petitioners seek bail in connection with East Colony P.S. Case No. 15 of 2023 instituted for the offence under Sections 147, 148, 149, 307, 302, 379, 504, 506, 509 of the Indian Penal Code.

There is allegation of assault by various means upon the brother of the informant along with some other co-

It has been submitted on behalf of the petitioners that the petitioner is in custody since 15-09-2023. Other than Petitioner No. 2, who has two criminal antecedents, there is no criminal antecedents on the rest of the petitioners. The motive, admittedly, is land dispute between the parties. There are general and omnibus allegation levelled against the petitioners. 5.

It has been further submitted by the petitioners counsel that petitioners has been falsely implicated in the present case. Other co-accused have been allowed bail by a Coordinate Bench of this Court vide order dated 22-06-2023, passed in Cr. Misc. No. 31860 of 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, nature of allegation, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with East Colony P.S. Case No. 15 of 2023 subject to the following

Patna High Court CR. MISC. No.76926 of 2023(2) dt.04-12-2023 3/3 conditions:

(I) One of the bailors shall be own/close member of the family of the petitioners.

(II) The petitioners shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioners.
