2. The petitioner seeks bail in connection with Sitamarhi P.S.Case No. 297 of 2023 instituted for the offences punishable under Sections 307, 120B of the Indian Penal Code and Section 27 of the Arms Act,
3. As per allegation in the FIR, while the informant was going to discharge his duty, one miscreant came near his vehicle and fired upon him due to which he sustained head injuries. The informant has strong suspicion that under conspiracy, Dr. Aash Bhushan has hired persons to kill him. 4 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.75694 of 2023(3) dt.28-02-2024 2/2 case. Neither the petitioner was named in the FIR nor he has any concern with the co-accused persons. During investigation, it has come in the light that specific allegation of firing is against Munchum Paswan and Dhiraj Singh. No TIP has been held till now. The petitioner is in custody since 21.07.2023 having clean antecedent.

Considering the facts and circumstances of the case as well as period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S.Case No. 297 of 2023.
