The petitioner seeks bail in Chandan (Anandpur) P.S. Case No.3 of 2017 registered under Sections 121, 121(A), 120(B) of the Indian Penal Code and Section 25(1-b)a and 26 of the Arms Act and under Section 9, 10, 11 and 13 of the U.A.P. Act.
The informant got information that some naxalites were holding a meeting on the instruction of Mantu Khaira, on such, the informant and others went inside the forest and found many persons were holding meeting. Ramayan Turi was apprehended and from his possession arms and ammunition were recovered. Ramayan Turi disclosed name of seven persons including the petitioner.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.75692 of 2018(2) dt.18-12-2018 2/2 petitioner was neither apprehended on the spot nor anything was recovered from the possession of the petitioner. Ramayan Turi and other accused persons namely Yogendra Marandi, Basudeo Khaira, Manoj Khaira and Mahesh Hansda have already been granted bail. The case of the petitioner stands on same footing. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Banka in connection with Chandan (Anandpur) P.S. Case No.3 of 2017.
