====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kuchaikote P.S. Case No. 261 of 2019 registered for the offences punishable under Section 353, 385 and 506 of the Indian Penal Code.

The allegation is regarding the petitioner being involved in facilitating the truck drivers to get their trucks passed illegally through the border of Bihar and Uttar Pradesh and he was apprehended by the police after the said activities of the petitioner was noticed by the Excise Inspector. Learned counsel for the petitioner has submitted that the said excise inspector, who is the informant of the present case, had seen the petitioner talking with one of the drivers of

It is further submitted that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 29.08.2019.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on regular bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Chief Judicial MagistrateVII, Gopalganj in connection with Kuchaikote P.S. Case No. 261 of 2019.
