Learned counsel for the petitioners has prayed for payment of enhance compensation on the ground that the market value of the land has not been paid by GAIL (Gas Authority of India Limited) for right of user of the petitioners' land by GAIL by laying of LPG gas pipeline. The LPG gas pipeline is passing through the land of the petitioners upto 18 meter down. Mr. Uday Bhan Singh, learned counsel appearing for the GAIL referring to Petroleum and Minerals Pipelines (acquisition of Right of User in Land) Act, 1962 submits that as per Section 10 of the Act, the petitioners may raises their grievance before the District Judge having jurisdiction in the local area.

3. In view of the aforesaid submission, learned counsel for the petitioners seeks permission to withdraw this application with liberty to raise their grievance before the

Patna High Court CWJC No.1234 of 2023(3) dt.23-09-2025 3/3 District Judge, Khagaria in accordance with law.

4. Permission is granted.

5. This writ petition stands dismissed as withdrawn with aforesaid liberty.
