2. The petitioner seeks bail in connection with Ishakchak P.S. Case No. 135 of 2023 registered for the offence under Sections 21(i)(b), 23 of the NDPS Act.

3. As per the prosecution case, 85 gms of Brown Sugar has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 15.7.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the recovery of intermittent quantity, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Bhagalpur in connection with Ishakchak P.S.
