2. The petitioners have prayed for grant of bail in connection with Excise(Jagdishpur) P.S. Case No. 181 of 2024 registered under section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that from the dickey of a car, altogether 64.890 liters of foreign liquor was recovered. Petitioners are said to be driver and co-passenger respectively of the said car.

4. Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They

It is further submitted by learned counsel for the petitioner that petitioner No.1 is driver and petitioner No.2 is co-passenger of the said car. They have no concern with the alleged liquor. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 13.09.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of this case, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Excise (Jagdishpur) P.S. Case No. 181 of 2024 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Exclusive Special Judge, Excise Court-II, Bhojpur at Ara.
