The petitioner seeks bail in anticipation of his arrest in connection with Chorpokhari P.S. Case No. 139 of 2019, dated 07.07.2019, instituted for the offences under Sections 341, 323, 308, 379 and 504/34 of the Indian Penal Code.

According to the accusation in the F.I.R., the petitioner, who is the son of the informant, along with his associates assaulted the informant as a result of which, he suffered injuries.

Patna High Court CR. MISC. No.68674 of 2019(2) dt.27-11-2019 2/2 Learned counsel for the petitioner has submitted that because of strained relationship between the father and the son, this allegation has been levelled against the petitioner. There is a counter version of the occurrence as well.

Notwithstanding the aforesaid arguments, I am not inclined to grant anticipatory bail to the petitioner as he is alleged to have assaulted his father.

The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, should the petitioner surrender before the Court below within a period of four weeks and seek bail, the Court below shall consider the case on its own merits without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
