2. The petitioner seeks regular bail in connection with Bisfi P.S. Case No. 39 of 2024, corresponding to G. R. No. 409 of 2024, registered for the offence punishable under Sections 302, 304B, 201/34 of the Indian Penal Code.
3. As per prosecution, the petitioner is the husband of the deceased. He further submits that the deceased died due to illness. He further submits that the deceased and the petitioner had a child aged two years who is staying with the petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner bears clean antecedent and is in jail since 08.02.2024.
5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid submission, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of A.C.J.M., Benipatti, District- Madhubani, in connection with Bisfi P.S. Case No. 39 of 2024, corresponding to G. R. No. 409 of 2024, with condition that petitioner shall cooperate in the trial either personally or through his lawyer on the date fixed in the trial.
8. At the time of furnishing bail bond, the child shall be produced by the accused side. If the court finds that the child is staying with the family of the accused-petitioner, then the bail bonds of the petitioner shall be accepted and if the court finds that the child is not staying with the family of the accusedpetitioner then the bail bonds of the petitioner shall not be accepted.
