The petitioner apprehends arrest in a case registered for the offence punishable under sections 279, 295 A, 379, 414, 417, 420, 428, 429, 465, 120B and the Indian Penal Code, Section 11 of the Prevention of cruelty to Animals Act 1960 and Section 3, 4 , 4(b) of Bihar Prevention and Improvement of animals Act, 1955.

As per the prosecution case, 47 cattle were being transported in a container illegally of which petitioner is registered owner.

Learned counsel for the petitioner submits that though the petitioner is registered owner of the said vehicle but illegal transportation of cattle was being done without his knowledge

Patna High Court CR. MISC. No.74174 of 2022(2) dt.06-04-2023 2/2 and consent. Furthermore, at the relevant time petitioner was in judicial custody since 11.3.2021 in connection with Gaya Civl Lines Police Station Case No. 43 of 2021 and was granted bail on 12.10.2022.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge Aurangabad, in Kasma Police Station Case No. 38 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
