The petitioner seeks bail in connection with Baligaon P.S. Case No. 42 of 2017 instituted for the offence under Section(s) 409/420 of the Indian Penal Code.

It is alleged in the written report that petitioner was Panchayat Secretary of Gram Panchayat Baligam and Chakjado falling under Patepur Block, District Vaishali. He was transferred from Patepur to Lalganj Block on 28.6.2016. It is further alleged that after receiving the transfer order dated 28.6.2016, the petitioner did not hand over the charge of Baligaon to Akhilesh Singh, Panchayat Secretary of Chakjado Panchayat despite clear order. It is also alleged that petitioner

Patna High Court Cr.Misc. No.79905 of 2018(2) dt.17-01-2019 2/2 had to deposit Rs. 9,64,200/- of Chakjado Panchayat and Rs. 11,12,200/- of Baligaon Panchayat totalling Rs. 20,76,200/- collected as social security pension, which he failed to deposit with the authority concerned.

Learned counsel for petitioner submits that petitioner has now deposited the total amount of Rs. 20,76,200/- with the authority concerned for which a letter was issued by the Block Development Officer, Patepur, Vaishali dated 30.11.2018 which is annexed as Annexure-2 to bail petition. Learned counsel further submits that petitioner has already handed over charge to officer concerned.

Petitioner is in custody since 5.10.2018 .

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 42 of 2017, subject to the condition that both the bailers shall be the close relative of the petitioner.
