The petitioner is in custody in connection with Bahadurganj P. S. Case No. 272 of 2018 for the offenses under Sections 370, 372, 376, 120B/34 of the Indian Penal Code, Sections 3, 4, 5 Immoral Trafficking Act and Sections 4 and 6 of POCSO Act.
Learned counsel for the petitioner would submit that from the materials available on the record it appears that petitioner was one of the associates in compelling the victim to join flesh trade. It is alleged that the petitioner was the driver who took the victim from Muzaffarpur to Kishanganj and thereafter the victim was forced to join flesh trade. No.80259 of 2018(2) dt.30-01-2019 2/2 criminal antecedent and one of the co-accused, who was directly responsible for forcing the informant to join flesh trade, was granted bail by a co-ordinate Bench of this court, the court has no option but to grant bail to this petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-Ist-cum-Special Judge, Kishanganj in connection with Bahadurganj P. S. Case No. 272 of 2018, subject to the condition that the bailors should be the elected representatives of the local bodies.
