The present application has been filed by counsel for petitioner seeking direction to demarcate the purchased land of the petitioner which is situated at Mauza Karanpur under Revenue Thana No. 642 pertaining to R.S. Khata No. 252 Khesara No.1 and Mauza Bhagwanpur under Revenue Thana No.643 pertaining to R.S. Khata No.82 Khesara No.2 & 3 an area of 27 Bigha 16 Kattha 15 1⁄2 dhur, Anchal-Bochahan District- Muzaffapur.

Counsel for petitioner submits that he has filed representation before the Deputy Collector Land Reform, West,

Patna High Court CWJC No.142 of 2023(2) dt.19-06-2023 2/2 Muzaffarpur (respondent no.3) as well as before the Circle Officer, Bochahan, Muzaffarpur (respondent no.4) for measurement but no action has been taken place. Counsel for State submits that at both the places, for measurement of land, he has filed a petition and sent through registered post which is not the proper way of filing application for measurement.

In this background, counsel for petitioner seeks permission to withdraw the writ petition to move before the appropriate authority, as mentioned in Rule 23 of Bihar Tenancy Rule.

Permission granted.

Counsel for petitioner is directed to file his application for measurement in proper proforma before appropriate authority.

With this direction, this civil writ application is hereby disposed of.
