The petitioner is languishing in custody since 30.07.2019 in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code and Sections 25(1-B)a, 26 of the Arms Act.

On the basis of the information that miscreants are preparing to commit dacoity, a raid was laid by the police, when five persons were apprehended and from the possession of the petitioner, two live cartridges and a motorcycle were recovered. Arms and ammunition were also recovered from other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present

Patna High Court CR. MISC. No.69378 of 2019(2) dt.27-11-2019 2/2 case and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that recovery of two cartridges and a stolen motorcycle has been made from the conscious physical possession of the petitioner. Considering the nature of recovery, investigation being concluded, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Danapur, Patna, in connection with Danapur P.S. Case No. 600 of 2019.
