The petitioners seek pre-arrest bail in connection with Barun P.S. Case No. 217 of 2019, registered under Sections 406 and 420 of the Indian Penal Code.

The accusation is that both the petitioners, being the Chairman and Manager of Kochhar Primary Agricultural Cooperative Credit Society of Barun Block, Aurangabad, received 8583 quintals paddy from farmers of which 5750.610 quintals cmr was to be supplied till 31.07.2019, but, only 4590 quintals rice were supplied and remaining rice 1180-610 worth Rs.30,31000/- misappropriated.

Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.67837 of 2019(2) dt.31-01-2020 2/2 that after initiation of the case, both the petitioners, being the Chairman and Manager of Kochhar Primary Agricultural Cooperative Credit Society, Barun Block, Aurangabad, has deposited the aforesaid amount with interest at Aurangabad District Cooperative Bank, Barun Branch, regarding which no objection certificate has been issued by the Branch Manager of the Bank on 10.01.2020, which would appear from Annexure 2. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Barun P.S. Case No. 217 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
