JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-03-2023 As prayed for by the learned counsel for the petitioner, he is permitted to make necessary correction in the cause title of the petitioner regarding name of district. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Alinagar P.S. Case No. 25 of 2021 registered for offence punishable under sections 498(A), 494/34 of the Indian Penal Code.

As per allegation, the informant was married to the petitioner on 18.04.2012 as per Hindu Rites and Rituals. The

Patna High Court CR. MISC. No.74287 of 2022(2) dt.20-03-2023 2/3 couple were leading happy matrimonial life and they were blessed with one son and one daughter. After birth of the daughter, the informant was harassed by the matrimonial inmates including the petitioner and they attempted to kill her after sprinkling kerosene on her person.

The learned counsel for both the parties have submitted that the matter has been resolved and the husband has assured to make a payment of Rs. 12,000/- (twelve thousand rupees) per month for maintenance of his children and his wife. The petitioner is agreed to construct a house in Benipur for residence of the informant and her children and he will keep the victim and children with full dignity and honour. As per submission, the petitioner has agreed to transfer the monthly installment of the maintenance in the bank account of the informant.

Considering the fact that both the parties have resolved their dispute, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Benipur, District-Darbhanga in connection with Alinagar P.S. Case No. 25 of 2021, subject to the following condition:-

If he fails to cooperate in the trial on two consecutive dates, the learned court below shall be at liberty to cancel his bail bonds.
