The petitioner seeks bail in connection with Kotwali (Tilka Manjhi) P.S. Case No. 518 of 2018 for the offence under Sections 25(1-B), 26 and 35 of the Arms Act. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Although the petitioner has been prosecuted under the Arms Act, but no arm has been recovered from the conscious possession of the petitioner rather four cartridges said to have been recovered and for the alleged recovery, the petitioner has sufficiently been punished as he has been under judicial custody since
Patna High Court Cr.Misc. No.1043 of 2019(2) dt.25-01-2019 2/2 09.08.2018 i.e. more than five months.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilka Manjhi) P.S.
