The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363, 366/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against the petitioner. He submits that the occurrence took place on 16.06.2020 but FIR has been lodged on 20.06.2022 after delay of four days. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.71277 of 2022(2) dt.31-01-2023 2/2 bail and submits that the victim in her statement has supported the prosecution case.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected n connection with Sadar P.S. Case No. 340 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
