JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Shambhuganj P.S. Case No. 38 of 2018, dated 08.03.2018, instituted for the offences under Sections 341, 323, 354 and 379/34 of the Indian Penal Code.
After some arguments, Mr. Ranjan Kumar Jha, the learned counsel for the petitioners, keeping in mind the fact that the petitioners were granted police bail earlier, seeks permission to withdraw this petition in order to enable the petitioners to approach the Court below for grant of regular
Patna High Court Cr.Misc. No.79768 of 2018(2) dt.15-01-2019 2/2 bail.
The petition is, accordingly, dismissed as withdrawn.
Once such an application is filed before the Court below, the Court below shall take into account that the petitioners have not misused the privilege of the protection which was granted to them by police and shall, thereafter, pass orders in accordance with the law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
