JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Chautham P.S. Case No. 198 of 2017, disclosing offences under Sections 406, 409, 420, 467, 468, 471, 34 of the Indian Penal Code.

Allegation against the petitioner, who is a Mukhiya of Gram Panchayat, is that huge amount was given for installation of solar lights, but the defective solar lights have been supplied. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and other co-accused persons have been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 12.09.2018 passed in Cr. Misc. No. 54186 of 2018. Further, the allegation is of supplying defective solar lights and also the amount has not been disclosed.

Having heard both sides, considering the above facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks and on surrender he will be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of court concerned till submission of charge-sheet with condition to cooperate in investigation of the case. However, even after investigation if charge-sheet is submitted against the petitioner, she has to surrender and make prayer fro regular bail, which shall be considered on the basis of materials available on record by the learned Court below.

With the above observation, this application is disposed of.
