JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mairwa P.S. Case No. 408 of 2018 for the offence under Sections 272, 273, 308/34 of the Indian Penal Code and Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.10.2018. He further submits that in the instant case 164.160 litres of foreign liquor was seized.

Considering the fact that the petitioner has got no criminal antecedent and he has remained pre-trial custody for more than three months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court Cr.Misc. No.1378 of 2019(2) dt.28-01-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Siwan in connection with Mairwa P.S. Case No. 408 of 2018.
