Petitioner is accused in connection with Muffasil P.S. Case No. 220 of 2018 registered under Sections 399, 402, 307, 353, 414, 120(B) of the Indian Penal Code and Sections 25(1V), 26, 35, 27 of the Arms Act. It is alleged in the written report that some criminals have assembled to commit some grave crime, the informant reached the place of occurrence and out of six one person was arrested, however, five managed to escape. The apprehended one in his confession has named petitioner to be one of the persons who had fled away.
Learned counsel for the petitioner has submitted that he is innocent and has committed no offence. He has falsely
Patna High Court Cr.Misc. No.79054 of 2018(2) dt.25-01-2019 2/2 been implicated in this case. He was not apprehended on the spot. Nothing has been recovered from his possession. He has no criminal antecedent and he is in custody since 12.09.2018. It has been further submitted that similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 30.11.2018 passed in Cr. Misc. No. 68712 of 2018.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Mufassil P.S. Case No. 220 of 2018.
